The Ledger Law Firm has been retained to represent shooting victim Douglas Cotter, who was seriously injured in the Las Vegas shooting, the worst mass shooting in modern U.S. history. On October 1, 2017, a gunman fired into a crowd enjoying a concert from the 32nd floor of the Mandalay Bay Resort and Casino in Las Vegas.
58 people were killed and more than 500 others were injured from the events that transpired. The Ledger Law Firm is representing one of the victims, and the case itself is made on behalf of all victims and festival attendees who experienced injuries and emotional distress due to the mass shooting.
As the facts surrounding the shooting unfolded, inconsistencies in reported accounts of the shooting have led to questions of whether MGM Resorts — the parent company of the Mandalay Bay Resort and Casino — were negligent in their attempts at preventing the mass shooting. Much of the debate is centered on a troubling six-minute gap between when law enforcement authorities indicate a Mandalay Bay Resort and Casino security guard was shot by the gunman and when the gunman opened fire on the concert attendees.
MGM Resorts alleges that this supposed timeline gap was based on premature information derived from a Mandalay Bay report, but the company now maintains that the six-minute gap timeline is not accurate in light of recent information.
Despite MGM’s assertions, lawsuits have already been filed by shooting victims who claim this apparent timeline gap is evidence of the hotel’s negligence, indicating that the hotel failed to respond or otherwise act in a timely manner.
In addition to the potential liability of MGM Resorts, the host of the Route 91 Festival — Live Nation — may be liable as well. If it can be shown that Live Nation failed to adequately design a venue with adequate emergency exits and/or failed to prepare employees for an appropriate emergency response, then the host may also be legally liable to shooting victims.
There may also be a claim against Slide Fire Solutions, LP, the manufacturer of the hotly-debated bump stock that was used to mimic automatic fire by the gunman.
