Assaultive conduct, also known as battery in the civil justice system, is any conduct amounting to an intentional offensive touching that would be considered unwarranted by the reasonable person with average sensitivities. The touching need not result in actual injury as long as it would be offensive to the reasonable person. In the criminal justice system, assaults are taken very seriously and the most severe types of assaults can land the assailant in prison for decades. In the civil realm, a battery (same definition) can result in damages awards in the hundreds of thousands of dollars depending upon the nature of the battery and the injury to the plaintiff (although an injury is not required).
Probably the most unspeakable type of assault is sexual assault which is an all-inclusive type of crime that can range from conduct from indecent touching to violent rape.
Orange County authorities are looking for victims of a male massage therapist allegedly sexually assaulting his clients. The offender worked in Seal Beach and three victims have already come forward to report the incidents. He has already been charged, as of Monday, with three felony counts of assault with an intent to commit a sexual offense. These three counts alone, if he is convicted, could result in incarceration up to eight years.
The offender is currently out after posting $100,000 bail and was scheduled to appear in court today. No word yet as to whether he showed up or how the the proceeding progressed.
Orange County prosecutors are adamant that the offender assaulted three female clients while he was employed at Seal Beach Massage Envy. The incidents took place between August 2009 and April 2010. As of present day, the offender is no longer licensed as a massage therapist in the state of California.
Incidents occurred both during routine massage treatments and other spa treatments.
