Price Out My Personal Injury – What’s My Case Worth?

It is difficult to understand, but your personal injury case comes at a price. Just the way that actuaries determine insurance charts and can tell how to pay for a claim based on facts and figures, your personal injury case has a sum definite worth.

In general, if you suffer an injury because of the wrongdoing of someone else, you can recover in damages for the injury. To be more specific, if you are physically injured as a result of the negligent actions of someone else, you can recover. Usually, you will be looking to be reimbursed for all of your injuries and damages. The idea is that you want to be put back in the same position that you were in before the loss occurred.

Let’s take a minute to ponder this one over. The law is interested in giving you compensation for your loss. What does this mean? Say, you have had an injury to yourself and your dog. Maybe your neighbor’s tree limb fell over the fence onto you and your pooch. You have physical injury to your foot, and your dog has injured a paw. But, unfortunately, it doesn’t stop there. You also need the fence to be replaced, the prize winning roses need to be bought again and replanted, and Fluffy has her paw in a cast, so the vet’s bill needs to be addressed. Also, you have been traumatized mentally by the tree limb falling on you at such an inopportune time (your 30th wedding anniversary party), and poor Fluffy won’t ever go near a tree again. I can’t add up all the damages in an itemized bill, but I would guess it is in the range of tens of thousands (really, it is more). You want the law to put you back to rights, and you will assume that this arbitrary figure will do the trick.

Now, if you are allowed to get a new fence, the law wants you to get the same fence you had before. If you need new roses, we don’t want you sending to the Royal Botanical Garden in London for replacement bulbs, just go to the local hardware store. And if Fluffy needs to be attended to, we want a vet to offer reasonable and customary priced treatment, not one that has doggy spa days included in all services rendered. Did I mention anything about the pain and suffering, or the punitive damages? No matter, it is not my business to pry. Those matters will be for the court to decide, that is if you get that far. My guess is that you will settle this one sooner than later, for the simple reason that these billings do get amplified before too long.
